Terms · version 2026-10-13

The terms on which Breakwise is read.

These terms cover the public surface, the Weekly, the Desk, sign-in, AI-assisted content, billing once it opens, and the informational, non-advisory nature of everything published. Publisher and hosting details are in the Legal Notice.

Educational research, not investment advice. I'm not a licensed adviser.

01Operator and scope

Breakwise is operated by the publisher identified in the Legal Notice ("we", "us"). These Terms govern access to and use of the site, the public surface, the Weekly, the Desk, sign-in, AI-assisted features, billing and any related content or service (together, the "Services"). By using the Services you accept these Terms. If you use them for an organisation, you confirm you may bind it.

02Definitions

Public: the parts of the Services open without sign-in. Weekly: the free weekly email and its archive. Desk: the daily desk, opened first to pilot readers (Today, Briefs, Changes, the call ledger, thesis bands, the evidence trail, Ask). Content: text, schematics, tables, labels, calls, emails, model-assisted output, design and code available through the Services.

03Eligibility and account

You must be eighteen or older and able to enter a binding contract. You may not use the Services where doing so would breach a law, sanction, professional rule or employer policy that applies to you. The Services are not directed at any person in a place where offering them would require a licence, registration or authorisation we do not hold, or that is subject to sanctions; you may not use them from such a place. We may refuse, suspend or cancel access, or restrict it by location, where we believe that applies. Sign-in is tied to your email address; you are responsible for that address and for activity under it. Access is personal and may not be shared, pooled, resold or transferred.

04Editorial, not advisory

Breakwise is educational research, not investment advice. Its producer is a retail trader, not a licensed adviser. The Services provide general, impersonal information and editorial opinion about the physical constraints of the AI buildout, published on a uniform basis to everyone who reads them. Nothing in the Services is portfolio management, brokerage, tax, legal or accounting advice, or any regulated financial service. We are not a licensed investment adviser or a member of any exchange or self-regulatory body. No fiduciary, advisory or suitability relationship arises between us and any reader.

Nothing is tailored to your situation. A call, a label, a thesis state, a band or a catalyst is an editorial framework and a dated record of the desk's own reasoning, not a recommendation to you. You alone are responsible for any decision you make and for engaging your own licensed advisers before acting.

05Positions, compensation and conflicts

The producer may hold positions in issuers the desk writes about. Positions that reach the threshold stated on the disclosures page are listed there with their dates; a trading blackout of forty-eight hours applies before and after any publication that names an issuer. No issuer, broker, exchange or vendor pays for coverage, and we pay none of them for placement. The desk's own setups, holdings and watchlists are never published.

06Subscriptions and billing

The Public surface and the Weekly are free. The Desk opens first as a pilot and charges nothing. If it is later offered as a subscription, it is offered yearly, at the price shown next to the subscribe button, billed in advance through Stripe. The renewal terms (price, term, that it renews automatically, and how to cancel) are shown beside the button before you pay and repeated in the confirmation email. A subscription renews automatically each year until cancelled; we email a reminder with the renewal date and price at least thirty days before it renews. You can cancel online at any time from the billing portal, with no call or email needed, taking effect at the end of the paid period. Prices include VAT where it applies. As a consumer in the EU you have fourteen days to withdraw from a distance contract; by asking for immediate access to the Desk you agree that the withdrawal right lapses once access is provided, as Art. 6:230p Dutch Civil Code allows. Refunds outside that right are at our discretion.

07Acceptable use

Content is for your personal use. You may quote short passages with attribution. You may not redistribute, republish, resell, scrape, crawl, extract, mirror, or use the Content or the Services to train or evaluate a model, nor probe, overload or interfere with the Services or another reader's access.

08AI-assisted content

Language models assist with extraction and drafting. Every extracted fact is gated on a verbatim quote from its document; every draft is labelled draft until a person accepts it; the producer is responsible for every publication. Model-assisted output can still be wrong, and every claim about a market carries a label saying how it knows.

09Availability and changes

The Services run on a best-effort basis without an uptime commitment. We may change, suspend or discontinue any part of the Services, and we may change these Terms; material changes are dated in §14 and, for subscribers, notified by email before they take effect. Continued use after the date is acceptance.

10Intellectual property

The Services and the Content are owned by the publisher and protected by copyright and database rights as stated in the Legal Notice. You receive a personal, revocable, non-transferable licence to read and use the Content within these Terms and nothing more.

11Warranties and liability

The Services are provided as they are. To the extent Dutch law allows, we exclude all implied warranties and are not liable for indirect or consequential loss, lost profits or trading losses arising from use of or reliance on the Content. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing limits liability for intent, gross negligence, or where the law forbids limitation; a consumer keeps every mandatory protection of the country where they live.

12Termination

You may stop using the Services at any time and cancel a subscription as described in §06. We may suspend or end access for breach of these Terms, for abuse, or where the law requires, refunding any prepaid unused period unless the termination is for breach.

13Governing law and disputes

Dutch law governs these Terms. Disputes go to the competent Dutch court, without prejudice to a consumer's right to the courts and mandatory rules of their own country. Complaints go first to the contact address in the Legal Notice; EU consumers may also use the online dispute resolution platform.
